BMW MOTORCYCLE OWNERS CLUB OF FLORIDA
CONSTITUTION
ARTICLE I NAME
The name of the organization will be "BMW Motorcycle owners Club of Florida" (BMWMOCF)
ARTICLE 2 OBJECTIVE
BMWMOCF shall function to promote safe motorcycle recreation within the legal and social boundaries of the community. The general theme of family participation shall prevail. The organizations primary focus is on BMW motorcycles, motorcyclists and motorcycling.
ARTICLE 3 ORGANIZATION
The organization shall elect sufficient officers to achieve the objectives of the club. The club shall be organized to be a ‘non profit’ organization.
ARTICLE 4 - MEETINGS
Sufficient meetings and communications shall be held to achieve the objectives of the club.
ARTICLE 5 AMENDING THE CONSTITUTION
Any revision or addition to the constitution will require a simple majority vote of the full members. Notification to all members must be made (2) months prior to a vote. Absentee ballots will be accepted. Every other year a committee will review the Constitution and propose changes as needed.

BY LAWS
A. ORGANIZATION:
1. NAME:
BMW MOTORCYCLE OWNERS CLUB OF FLORIDA, Hereinafter referred to as "The Club".
2. CHARTERS:
A. # 31 BMW MOTORCYCLE OWNERS OF AMERICA
B. # 28 BMW RIDERS ASSOCIATION
C. # 5699 AMERICAN MOTORCYCLIST ASSOCIATION
3. PURPOSE:
The purpose of the club is to promote safe motorcycle recreation within the legal and social boundaries of the community. The general theme of family participation shall prevail. The primary focus is on BMW Motorcycles, motorcyclists and motorcycling.
4. MEETINGS:
The General Business Meeting will be held during the third week each month, except for June, July and August. The President may call special meetings.
5. THE BYLAWS:
Additions, deletions and amendments to the Bylaws require a simple majority vote of the full members. All members must receive notification at least two months before a vote on the Bylaws. Every other year a committee will review the Bylaws and propose changes as required.
6. FULL MEMBER:
A Full Member is or has been a rider/owner (and spouse/companion) of a BMW Motorcycle or has been an associate member for 2 years.
7. ASSOCIATE MEMBER:
An Associate Member is a rider/owner (and spouse/companion) of a non BMW Motorcycle who is interested in furthering the purposes of the BMWMOCF.
Associate members may serve as officers other than President, Vice president or Treasurer. They may vote on all issues except bylaw revisions or disbandment. They may serve on all committees except the bylaws committee.
8. HONORARY MEMBER:
A person accepted by the membership who has made significant contribution to the club and whose induction into membership is sponsored by a full member.
9. VOTING:
All matters brought before the members will be decided by a simple majority vote of the members (full and associate) present.
10. OFFICERS:
The executive board of the Club will consist of the President, Vice President (if elected as below or approved by paragraph A9), Secretary and Treasurer. Each of these officers must be an AMA member and during their term of office, the Club will pay their AMA dues as "AMA Extra Mile Members."
Additional officers of the club will be Road Captains (3), Newsletter Editor, Historian and AMA legislative officer.
The term of office of all officers will be one year. The officers will be nominated at the November meeting, elected at the December meeting and installed during January.
The duties of the officers are as follows-
A. THE PRESIDENT SHALL:
1. Be responsible for the organization and supervision of meetings.
2. Be authorized to enter into contracts on the behalf of the club. Approval of the membership is required.
3. Be authorized to sign checks.
B. THE VICE PRESIDENT (if elected):SHALL
1. Be responsible for assisting the President and the Road Captains.
2. Assume duties of the President and Road Captains in their absence.
3. Assume the duties of rally chairman in their absence.
4. Be Chairman of the nominating committee.
5. Be authorized to sign checks.
C. THE SECRETARY SHALL:
1. Be responsible for basic correspondence, transcribing the minutes of each meeting, maintaining a complete record of both and representing the minutes at the following meeting.
2. Maintain a roster of membership.
3. Act as President in absences of the President and Vice President.
D. THE TREASURER SHALL:
1 Be responsible for keeping an accurate record of all financial matters.
2. Be responsible for maintaining a record, signing checks and presenting a complete monthly financial report at each meeting.
3. The executive board will conduct a yearly financial audit.
E. THE ROAD CAPTAINS SHALL:
1 Be responsible for organized club rides
2. Keep an accurate record of the memberships motorcycle mileage.
F. THE NEWSLETTER EDITOR SHALL:
1. Be responsible for editing and publishing a newsletter.
2. Be the clubs public relations officer.
G THE HISTORIAN SHALL:
1. Be responsible for maintaining scrapbooks.
2. Display club memorabilia at appropriate activities.
H. THE PAST PRESIDENT SHALL:
1. Serve in an advisory position to the club and the executive board.
I THE AMA LEGISLATIVE OFFICER SHALL:
1. Be the focal point for the club with the American Motorcyclist Association.
2. Report to the membership about legislation that will affect the privileges of motorcyclists.
3. Encourage members to become active in the AMA.
J THE EXECUTIVE BOARD SHALL:
1. Take timely actions for the club, that are needed, where, in the judgment of the board, time of is of the essence and normal club action is not possible.
2 Any actions taken shall be reviewed with the membership as soon as possible.
B. MEMBERSHIP:
1. ELIGIBILITY:
A. Consideration for full membership will be open to the owner (and spouse/companion) of a BMW motorcycle.
B. Consideration for associate membership will be open to the owner (and spouse/companion) of any motorcycle.
C. Prospective members will attend at least one (1) club meeting or activity before being considered for membership.
D. A simple majority vote will be required to be accepted for membership.
E. Participants of the Tentpegger Rally will become Associate members for 30 days. Should they choose to continue their membership and provided they meet the membership requirements, regular membership fees will apply and two dollars of the rally fee will be applied toward their membership fee.
2. MEMBERSHIP FEES:
A. New members will pay a $5.00 initiation fee, plus $1.00 per month up to and including the month of December.
B. Dues will be $12.00 per year per member due January 31. Dues not received will subject members to being dropped from the club.
3. LIFETIME MEMBERSHIP:
Fifteen (15) continuous years of membership will entitle the member to "lifetime membership". Lifetime members are not required to pay dues. Lifetime members are required to pay $6.00 per year, due Jan 31, to cover administrative costs. All lifetime members are full members.
4. MISCONDUCT:
Any member considered for termination of membership due to questionable conduct will appear before the executive board with the complaining member. After reviewing the complaint, the executive board will decide by secret ballot whether to expel the member(s). A vote of ‘yes’ by all members present on the executive board shall be needed to expel any member(s) of the club without bringing the matter to the full membership. A unanimous vote of the ‘no’ by the members present on the Executive Board will drop the complaint. If there is not a unanimous vote then said matter shall be brought before the general membership.
C. ACTIVITIES:
Any activities not typically designated as closed will be considered to be open to nonmembers. Typical activities are the banquet, picnics, Thursday night socials, monthly meetings, the Tentpegger Rally and club sponsored rides.
A. RIDES:
The Road Captains will supervise and brief organized club rides. All rides will conform to the formation specified by the Road Captain.
B. TENTPEGGER RALLY:
The Tentpegger Rally is the major event sponsored by the club. Occurrence of the Tentpegger Rally shall be subject to the naming of a Rally Chairman (volunteering, appointment and/or selection) from the membership (full or associate) 1 year prior to the date of the Rally.
Contractual commitments, reservations, deposits etc. shall not be made without the naming and approval of the rally chairman.
Typically and historically the rally is held in mid April. Other dates may be considered as determined by the Rally Chairman and approved under A9, VOTING
Members will be ineligible for prizes and awards at the Tentpegger Rally. Members are expected to be working participants at the rally.
C. MEETINGS:
Monthly Meetings shall be held at a location and time as practical and as determined by the President and executive board with consideration by the membership.
General principles of Roberts Rules of order shall be used to guide club meetings.
D. PICNICS:
As a goal picnics shall be held yearly or more often, when and where as practical.
D. EXPENDITURES:
The club will support worthy causes. The organizations and the manner in which they will be supported must be approved by the membership
Membership approval will be required for any expenditure exceeding $100.00.
E. ASSESSMENTS:
Assessments may be made to all members to keep the club solvent. These will be limited to $3.00 per month per all members.
F. DISBANDMENT:
Should the club disband, the assets will be distributed to a like organization.
Roberts Rules of order shall be used to guide club meetings.
